ビットコインの不正引き出しの捜査開始 “Launching an investigation of an illicit withdrawal of Bitcoins.”

７月３０日、警視庁サイバー犯罪対策課(Cyber Criminal Investigation Division of Metropolitan Police Department)は、不正アクセス(illicit access)によって約１６億円相当のビットコインが引き出されたとして電子計算機使用詐欺(Computer Fraud)の疑いで捜査を開始しました。本件に適用された刑法の条文の対訳は以下のとおりです。

刑法（電子計算機使用詐欺）

第二百四十六条の二　前条に規定するもののほか、人の事務処理に使用する電子計算機に虚偽の情報若しくは不正な指令を与えて財産権の得喪若しくは変更に係る不実の電磁的記録を作り、又は財産権の得喪若しくは変更に係る虚偽の電磁的記録を人の事務処理の用に供して、財産上不法の利益を得、又は他人にこれを得させた者は、十年以下の懲役に処する。

Penal Code (Computer Fraud)

Article 246-2 In addition to the provisions of Article 246, a person who obtains or causes another to obtain a profit by creating a false electromagnetic record relating to acquisition, loss or alteration of property rights by inputting false data or giving unauthorized commands to a computer utilized for the business of another, or by putting a false electromagnetic record relating to acquisition, loss or alteration of property rights into use for the administration of the matters of another shall be punished by imprisonment with work for not more than 10 years.

上記英訳（法務省による）では、「不正な指令」は“unauthorized commands”となっています。“unauthorized”は“not having official permission or approval”（公式の許可又は承認を得ないこと）という意味で、通常の英文契約書の翻訳では、「無権限」との訳語が対応するところです。そこで、より「不正」の意味に近い“illicit”を代わりにあててはどうかと思いましたが、illicitは、“forbidden by law, rules, or custom”（法律、規則又は慣習により禁止されていること）との意味で、「違法」「不法」と訳されるべき単語です。違法な行為である電子計算機使用詐欺の具体的内容を規定する条文内において、「違法」又は「不法」という語を使用するのは一種の循環定義となってしまいそうです。

ところで刑法第３６条１項（正当防衛）の「急迫不正の侵害」の訳は“imminent and unlawful infringement”であり、「不正」を"unlawful"と翻訳しています。この“unlawful”は、“not conforming to, permitted by, or recognized by law or rules”（法律又は規則に適合せず、これらによって許可されず、又は認められないこと）との意味ですので、不正をillicitと訳した場合と同様の問題（循環定義）が生じます。

このように考えると「不正な指令」の翻訳語として、“unauthorized commands”は適切なのかもしれません。
